These Terms & Conditions ("Terms") govern your access to and use of the website, podcast, courses, community, and any digital products or services offered by Blitz Marketing Inc. dba The Mom Era ("The Mom Era," "we," "us," or "our"). By accessing or using any part of our platform, you agree to be bound by these Terms.

Acceptance of Terms

By using this website or purchasing any product or service, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that you agree to these Terms in full. If you do not agree, please do not use our platform.

Description of Services

The Mom Era offers a range of digital products and services including, but not limited to: a podcast, online courses, a membership community, digital downloads, live events, and coaching content. The availability, features, and pricing of these offerings may change at any time without notice.

Accounts & Registration

Certain areas of our platform require account registration. You agree to provide accurate and complete information, to keep your login credentials confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

Purchases, Payment & Pricing

All prices are listed in Canadian dollars (CAD) unless otherwise specified. We reserve the right to change pricing at any time. Payment is due at the time of purchase. We use secure third-party payment processors and do not store your payment card information. Where applicable taxes apply (including GST/HST), they will be added at checkout.

Refund Policy

Due to the digital nature of our products:

• Digital downloads and pre-recorded courses: All sales are final. No refunds are provided once access has been granted, except where required by applicable consumer protection law.

• Memberships: Monthly memberships may be cancelled at any time; you will retain access until the end of your current billing period. No partial-period refunds.

• Live programs or events: Refund terms will be specified at the time of purchase. If no refund terms are stated, refunds are at our sole discretion.

If you believe you have a valid claim for a refund, contact us at hello@joinmomera.com within 5 business days of your purchase.

Intellectual Property

All content on The Mom Era platforms — including but not limited to text, graphics, logos, podcast episodes, course materials, videos, worksheets, templates, and community content created by us — is the sole property of Blitz Marketing Inc. and is protected by Canadian and international copyright and intellectual property laws. You may not reproduce, redistribute, sell, publish, modify, create derivative works from, or otherwise exploit any content without our prior written permission.

Licence to Use Digital Products

When you purchase a digital product or course, you are granted a limited, personal, non-exclusive, non-transferable licence to access and use that content for your own personal, non-commercial purposes. This licence does not include the right to share, resell, sub-licence, or distribute the content to any third party.

Community Conduct

If you participate in any The Mom Era community platform, you agree to:

• Treat all members with respect and kindness

• Not post spam, unsolicited promotions, or commercial solicitations

• Not share, distribute, or reproduce paid content outside the community

• Not post content that is defamatory, harassing, discriminatory, or otherwise harmful

• Not engage in any activity that violates applicable law

We reserve the right to remove any content and revoke community access without refund for violations of these conduct standards, at our sole discretion.

User-Generated Content

By submitting content (comments, testimonials, posts, photos, or other materials) to any The Mom Era platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute that content for the purpose of operating and promoting The Mom Era, without compensation to you. You represent that you own or have the right to share any content you submit.

Affiliate & Partner Disclosure

The Mom Era may participate in affiliate programs. This means we may earn a commission if you purchase a product or service through a link we share. We only recommend products and services we genuinely believe in. All affiliate relationships will be disclosed in accordance with applicable advertising guidelines and the Competition Bureau of Canada's guidelines on influencer marketing.

Disclaimer of Warranties

Our website, content, and services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, Blitz Marketing Inc. dba The Mom Era shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our platform or any products and services. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Blitz Marketing Inc. dba The Mom Era, its directors, officers, employees, agents, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of our platform, your violation of these Terms, or your violation of any rights of a third party.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of our platform shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Toronto, Ontario, Canada, or to the courts of competent jurisdiction in Ontario.

Modifications to These Terms

We reserve the right to modify these Terms at any time. We will post updated Terms with a revised date. Continued use of our platform following any changes constitutes your acceptance of the revised Terms. If changes are material, we will make reasonable efforts to notify registered users.

Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Blitz Marketing Inc. dba The Mom Era with respect to your use of the platform, and supersede any prior agreements or understandings.
